Answer Yes. Proper use of the symbols TM, SM, & � is critical in notifying the public of a claim of rights in the mark. The TM and SM symbols can be used when you want to show your intention to secure and are in the process of registering a mark, but the � symbol may only be used once the mark is actually registered.
