Answer Employment testing is subject to federal government laws and regulations. In addition, in certain areas, state law or regulations define limitations relating to employment tests.
Equal employment opportunity laws prohibit use of tests or other selection procedures that discriminate on the basis of race, color, sex, religion, national origin, age, and disability. Anti-bias laws in certain states define other protected-class categories. The U.S. Equal Employment Opportunity Commission (EEOC) guidelines on testing procedures (Uniform Guidelines on Employee Selection Procedures) state that employers may not use tests that intentionally or unintentionally screen out a particular protected class group unless the test has been validated.
