Consider the following employment test tips to help you avoid legal exposure:

- The test should be directly related to measuring skills, knowledge or other attributes used on the job.
- Apply the test uniformly to all job candidates for a particular job.
- Use a consistent approach for scoring, grading or evaluating test results.
- Protect confidentiality of test results and other application information.
- Provide reasonable accommodation in the testing process if testing a disabled individual.
- Keep a test sample with the individual's application or in a separate test file.

Final note: If the test is a medical exam or test procedure, the results must be kept in a file that is separate from employment applications and employment records.
