Employment testingQuestion Is the use of an employment test limited by or subject to employment laws?
Answer Employment testing is subject to federal government laws and regulations, and some state law or regulations define limitation relating to employment tests.
According to Equal Employment Opportunity Commission (EEOC) guidelines, an employment test must relate to some aspect of the job and it must be a true measure of the skill or ability that is being tested. Equal Employment Opportunity laws prohibit use of tests or other selection procedures that discriminate on the basis of race, color, sex, religion, national origin, age, and disability. Anti-bias laws in certain states define other protected class categories.
