To minimize likelihood of legal claims, it is important to show a clear business purpose for the test. Limit its inquiry into those areas that are related to job performance. Then protect confidentiality of test results. Also, avoid inquiries that probe into private aspects of one's life. If psychological testing is used, it is best to work with an industrial psychologist experienced in development, administration, and interpretation of employment tests.
